Terms & Conditions – RockyPay

RockyPay is a digital payment gateway platform operated by RockyPay Private Limited. This document outlines the Terms of Use, Privacy Policy, Refund Policy, and Chargeback Policy. It is updated for legal compliance with Indian law, including RBI Guidelines, the Information Technology Act, and the Consumer Protection Act.

1. Terms of Use

  • 1.1 Eligibility: Users must be 18 years of age or older and possess a valid PAN/Aadhaar to use our services
  • 1.2 Account Creation: Users are responsible for maintaining the confidentiality of account credentials.
  • 1.3 Prohibited Conduct: Activities such as fraud, abuse, unauthorized access, and money laundering are strictly prohibited.
  • 1.4 Termination: RockyPay may suspend or terminate services for violations of terms or applicable laws.
  • 1.5 Dispute Resolution: Disputes shall be resolved through arbitration under Indian Arbitration & Conciliation Act, 1996.
  • 1.6 Indemnity: Users agree to indemnify RockyPay for any losses arising from violations of these terms.
  • 1.7 Limitation of Liability: RockyPay shall not be liable for indirect or consequential damages.

3. Privacy Policy

Complies with IT Act, 2000 and SPDI Rules, 2011. Covers collection, processing, storage, and sharing of personal and transactional data. Includes user rights to access, correction, withdrawal of consent, and deletion.

4. Refund Policy

  • 4.1 Refund Window: Refunds can be requested within 3–5 business days of the transaction date.
  • 4.2 Processing Time: Approved refunds processed within 24–72 hours to the original payment method.
  • 4.3 Non-Refundable: Gateway fees and successfully delivered services are non-refundable.

5. Chargeback Policy

RockyPay manages chargeback disputes internally with clear processes for merchant notification and evidence submission. Customers are encouraged to contact RockyPay first before raising a bank dispute.

6. Merchant Terms

A separate Merchant Terms of Service shall be published covering onboarding, fees, settlement cycle, and risk policies.

7. Governing Law & Jurisdiction

These terms are governed by Indian law. Disputes shall be subject to the exclusive jurisdiction of courts in [Madhya Pradesh].

8. Compliance Statement

RockyPay affirms compliance with RBI Guidelines on Payment Aggregators and IT Act regulations. Suspicious activity may be reported to FIU-IND per AML requirements.
